Form 23 Compliance Certificates

If your pool meets all safety requirements, we’ll issue your official Form 126 – Certificate of Compliance, valid for 3 years and required for any sale or lease. This certificate confirms your pool is legally compliant and safe for use.

Re-Inspections and Support

Once your rectification work is complete, we’ll return for a reinspection and, if all items are resolved, issue your Form 126. We’re happy to answer questions, recommend trades, or help interpret council guidelines.

Do I need a pool safety certificate in NSW?

Yes. If you're selling or leasing a property with a swimming pool or spa in NSW, you're legally required to have a Certificate of Compliance (Form 126) or a Non-Compliance Certificate (Form 24) issued by a licensed certifier.

How long is a Certificate of Compliance valid for in NSW?

A Form 126 – Certificate of Compliance is valid for 3 years from the date of issue, provided no changes are made to the pool barrier during that time.

What is the difference between Form 126 and Form 24?

Form 126 is issued when your pool is fully compliant with NSW regulations. Form 24 is a Notice of Non-Compliance issued if the pool fails inspection. It allows a property to be sold with the understanding that the buyer must rectify the issues within 90 days of settlement.

Do I need to register my pool in NSW?

Yes. All pools and spas in NSW must be registered on the NSW Swimming Pool Register. A property cannot receive a certificate without first being listed.

Can I still sell my house if the pool isn’t compliant?

Yes, but only with a Form 24 – Non-Compliance Certificate. This form must be attached to the contract of sale, and the buyer becomes responsible for achieving compliance within 90 days after settlement.

What is checked during a pool inspection in NSW?

Yes. A compliant CPR sign must be displayed in a visible location near the pool area and meet the requirements outlined in the Swimming Pools Regulation 2018.

Can I do a virtual inspection instead of onsite?

No. NSW law requires an onsite inspection to issue a valid certificate. However, we do offer virtual pre-assessment reviews to help you prepare and identify likely non-compliance issues before booking your formal inspection.

Who can issue a pool compliance certificate in NSW?

Only an accredited certifier registered under the Building Professionals Board (BPB) or authorised council inspector can issue a valid pool compliance certificate in NSW.
