Do I need a pool safety certificate in Queensland?

Yes. If you're selling or leasing a property with a regulated pool or spa in QLD, you must have a valid pool safety certificate (Form 23) issued by a licensed pool safety inspector.

How long is a pool safety certificate valid in QLD?

For non-shared (private) pools: 2 years. For shared (e.g. body corporate) pools: 1 year. After this period, a new certificate is required if the property is being sold or leased again.

What is a Form 23?

Form 23 is the official Pool Safety Certificate in Queensland. It confirms that your pool complies with current safety standards. It must be lodged with the QBCC and is legally required for certain transactions.

What happens if my pool doesn’t pass the inspection?

If your pool is non-compliant, the inspector will issue a Form 26 – Nonconformity Notice outlining what must be fixed. You’ll then need to rectify the issues before requesting a reinspection.

What does the inspection include?

The inspector checks fencing, gate latches, climbable objects near barriers, non-climbable zones (NCZs), CPR signage, and compliance with AS1926.1 and QLD’s pool safety laws.

Do I need to be home during the inspection?

Yes. Someone over 18 should be present to provide access to the pool area and any gates or outdoor spaces required for inspection.

Can I sell my home without a current pool safety certificate?

Yes, but only if you provide the buyer with a Form 36 – Notice of No Pool Safety Certificate before settlement. The buyer then has 90 days after settlement to obtain a certificate.

Is CPR signage required for all pools in QLD?

Yes. A compliant CPR sign must be securely displayed and easily visible from the pool area. It must comply with the version in Schedule 2 of the Building Regulation 2021.
